Example of Duties
Openings
Provide legal counsel and representation when appointed by the Court in actions for those who do not have private attorneys and who are deemed indigent by the Court in the following matters:
- CHIPS proceedings against parents
- TPR proceedings against parents
Representation in these matters are for post dismissal or post adjudication matters and for new cases filed July 8, 2008 or later.
The rate of pay will be $70/hour and subject to court approval. A contract will be entered into and further terms will be mutually agreed. There are NO benefits with this position.
Background
Since the 1994 Public Defender takeover by the State of Minnesota, the courts have regularly appointed public defenders to represent indigent parents in children in need of protection or services (CHIPS) and termination of parental rights (TPR) cases. Public defenders across the state have accepted such appointment. On June 5, 2008, the Board of Public Defense approved a revised fiscal year 2009 budget to address a $3.8 million deficit. As a result, the Board of PD eliminated the delivery of non-mandated services effective July 8, 2008. Minnesota Statute 611.14 requires a minor ten years of age or older in any juvenile court delinquency or child protection proceeding (excluding proceeding for petty offenses) to be represented by a public defender. The Board of PD will continue to provide this mandated service, but will no longer appoint a public defender to represent the parents of CHIPS or TPR cases.
